Czech Republic's 'Trumpist' PM-Elect Declines to Divest Business Empire Amid Ethical Dispute

Andrej Babiš, the self-proclaimed tycoon who secured victory in the recent parliamentary vote, has declined to offload his extensive business interests, while asserting he will address a ethical dilemma that might prevent him from assuming the role of prime minister.

Stance on Business Holdings

Babiš, whose political movement came first in the October election but did not secure a parliamentary majority, stated in a online statement that he will not sell his Agrofert conglomerate, which is active in farming, food processing, and chemicals.

“I have repeatedly said I will not sell Agrofert. I have repeatedly said I will resolve the conflict of interest in compliance with Czech and European laws,” Babiš commented. “This is different from selling a pastry in a bakeshop.”

Head of State's Requirement

The head of state, Petr Pavel, stated that the 71-year-old populist must publicly explain how he will eliminate ethical conflicts arising from his business activities before assuming the role of prime minister.

The Czech constitution “clearly mandates the head of state to take into account the potential occurrence of a conflict of interest and the ways to address it” when selecting government ministers, the presidential administration noted.

The president “wants it to be clear in what precise manner Andrej Babiš will meet his statutory duties”, the announcement said, noting that Pavel was ready to appoint Babiš as prime minister “without delay” once the issue was settled.

Business Operations and Regulatory Concerns

Babiš's several hundred firms, mostly under the Agrofert umbrella, function in the nation and other central European countries, receiving substantial funds in domestic and European farming and other grants, as well as public contracts.

Under national legislation, cabinet members cannot obtaining public aid or contracts. The anti-corruption watchdog Transparency International has stated that to prevent a ethical breach, Babiš must either sell, decline government deals, or not enter public office.

Previous Tenure and Present Intentions

Babiš said he would “abide by the regulations” if selected as premier, but declined to detail how in beforehand because the matter was “an extremely sensitive and private affair for me, and the media will always criticise me regardless”.

During his first term as premier, from 2017 to 2021, Babiš faced multiple court cases and an EU investigation over potential conflicts of interest. He temporarily moved his assets into trust funds, while keeping some influence over them.

A judicial body and the European Commission both ruled that this did not suffice. Babiš stated recently that he was once more the exclusive proprietor of Agrofert and maintained he was “implementing measures” to prevent a conflict of interest, but declined to disclose details.

Coalition Deal and Foreign Policy Implications

The wealthy politician has signed a coalition agreement with two rightwing fringe parties, the far-right, pro-Russian SPD, which has called for a public vote on leaving the EU, and the Motorists for Themselves, which has mainly opposed the EU’s Green Deal.

The incoming administration, if confirmed, is likely to strengthen the populist movement in the region and could challenge backing from Western nations for Ukraine – even though Babiš has contacted Ukraine’s leader, Volodymyr Zelenskyy, to confirm of the nation's backing.

Pavel, who as head of state shares responsibility for international relations, also requested that the government agenda include a declaration on the government’s position on the conflict in Ukraine, with a commitment to fulfilling alliance duties.

The head of state has earlier said he would not approve any cabinet candidates who might doubt the Czech Republic’s EU and Nato commitments, a condition that the ultra-conservative party has said it will satisfy by proposing independent technocrats.
